Agreement to These Terms

This license ends automatically if you violate these restrictions. We may suspend or terminate access at any time when reasonably necessary to protect the Website or users.

User Obligations and Submissions

Contractors are independent businesses, not employees or agents of Trueway unless expressly stated in a separate written agreement. Any service relationship, scope, scheduling, price, performance, license, insurance, and other terms must be confirmed directly with the contractor.

The Website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not promise that the Website will always be available, accurate, complete, current, secure, or error-free. General information is not professional, legal, medical, structural, or individualized pest-control advice.

We do not endorse or control independent contractors, third-party links, or third-party content. Nothing on the Website creates a warranty, guarantee, partnership, agency, fiduciary relationship, or promise about a contractor’s work. You are responsible for evaluating and selecting any contractor.

Limitations of Liability

To the fullest extent permitted by law, Trueway Pest Control and its owners, officers, employees, agents, affiliates, vendors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, personal injury, property damage, or other losses arising from or related to your use of, or inability to use, the Website or any interaction with an independent contractor or third party.

Where liability cannot be excluded, it will be limited to the amount you paid directly to Trueway for use of the Website during the six months before the event giving rise to the claim, or 100 dollars if you paid nothing, to the extent permitted by law.

Revisions to the Website and These Terms

We may change, suspend, or discontinue any part of the Website, content, forms, or features without notice. We may revise these Terms by posting an updated version and effective date. Your continued use after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.

Release

This release does not waive rights that cannot lawfully be waived.

Dispute Resolution and Arbitration

Please read this section carefully. To the extent permitted by law, you and Trueway agree to first try in good faith to resolve a dispute by contacting the other party through the Contact Us page. If the dispute is not resolved, it will be resolved by individual, binding arbitration rather than a jury trial or class action, except for eligible small-claims matters or a court action seeking to protect intellectual property or prevent unauthorized access.

The arbitrator, not a court, will decide the scope, enforceability, and interpretation of the arbitration agreement, except that a court may decide whether the class-action waiver is enforceable. Arbitration will take place in the county where you live or work, or another location the parties agree to. You and Trueway waive the right to participate in a class, collective, or representative proceeding to the extent permitted by law.

You may opt out of this arbitration and class-action provision by sending written notice through the Contact Us page within 30 days after first accepting these Terms. If you opt out, the remaining Terms continue to apply.

Governing Law and Venue

These Terms and disputes relating to the Website are governed by the laws of the State of California, without regard to conflict-of-law rules, except where federal law controls. Subject to the arbitration section, courts located in Sacramento County, California, will have jurisdiction and venue for disputes that may be heard in court.

Copyright and Intellectual Property

Website design, text, graphics, logos, images, software, and other materials are owned by or licensed to Trueway Pest Control and are protected by copyright, trademark, and other laws. You may not use the Trueway name, logo, or marks without written permission.

If you believe content on the Website infringes your copyright, send a detailed notice through the Contact Us page identifying the protected work, the allegedly infringing material and URL, your contact information, a good-faith statement, an accuracy and authority statement, and your physical or electronic signature.
